1. Validity of conditions of sale
1.1 The conditions of sale are valid between the buyer at the myov.be web store (hereafter referred to as the ‘consumer’) and the trader Baltiny OÜ (the ‘web store’) for the purchase of goods and services.
1.2 In addition to these terms and conditions, legal relationships arising from the purchase of products from the myov.be web store are regulated by the Law of Obligations Act (LOA), the Consumer Protection Act (CPA) and other legislation applicable in the Republic of Estonia.
1.3 The myov.be web store reserves the right to change the conditions of sale. These changes will be made available on the web page myov.be
2. Price information and Methods of payment
2.1 All prices at the myov.be web store include a value added tax of 22 %.
2.2 Prices are valid from the date of placing an order until the expiry of the payment date of the order (1 day after placing the order).
2.3 The myov.be web store reserves the right to make changes in sales prices. These changes will be made available on the web page myov.be
2.4 Fee for shipping is added to the price. The shipping cost depends on the location of the purchaser and the shipping method. The shipping cost is displayed when the purchaser places the order.
2.5 The order can be paid for securely using Estonian bank links (Swedbank, SEB, Luminor, Danske, LHV, Coop and Pocopay).
2.6 Payment is made outside the e-shop in the secure payment environment of the service provider Maksekeskus AS.
2.7 The seller does not have access to the customer’s bank details and credit card details.
2.8 Payment is made in euros.
3. Placing an order
3.1 Add the desired products to your shopping cart.
3.2 To place an order, first click on the ‘Place an order’ link on the shopping cart page.
3.3 Fill in the required information fields on the checkout page, select a suitable delivery method and click on the ‘Order with payment obligation’ link. You will then see an invoice, which you can conveniently pay via a bank link (Swedbank, SEB, Nordea, etc.) or through other bank payment methods such as a euro payment. The details of your order and copy of the invoice will also be sent to your e-mail.
3.4 Fill in the fields on the information and order confirmation pages carefully, as the accuracy and correctness of the data submitted affects the fast and smooth delivery of your purchases and the subsequent settlement of potential disputes and complaints.
3.5 Orders placed via the web store are processed every day 9:00 a.m – 05:00 p.m without weekends (excluding holidays of the Republic of Estonia).
4. Entry into force of the contract of sale
4.1 With the contract of sale, the myov.be web store undertakes to deliver to the consumer available and soon-to-be-produced goods as well as the goods that the myov.be web store will obtain in the future and to transfer their ownership to the consumer, whereas the consumer undertakes to pay to the myov.be web store for the goods in the amount indicated on the invoice and to accept the goods.
4.2 Orders that have not been paid for will be cancelled 48 hours after placing the order.
4.3 The contract of sale enters into force after the receipt of the payment made by the consumer on the bank account of the web store.
5.Delivery
5.1 After the entry into force of the contract of sale the myov.be web store assembles the order and hands it over to the company’s logistics partners for delivery.
5.2 Delivery times indicated on the web store’s website apply from the moment the web store receives the payment for the order on its bank account.
5.3 In order to avoid delivery delays, the order forms have to be filled in carefully and the delivery information submitted should be accurate and valid.
5.4 The myov.be web store is not responsible for a delay in delivery if the goods were handed over to the logistics partners on time, but the delivery was delayed due to circumstances that the myov.be web store could not foresee or control.
5.5 The customer can choose Сourier Door-to-door or pickup from store to deliver the order.
5.5.1 There may be a waiting period of 3-8 days for delivery.
5.6 Delivery of the order to Сourier Door-to-door.
5.6.1 Delivery charge of € 15 (Harjumaa and Tallinn) € 45 (Estonia) will be added to the order price.
5.7 If upon receipt of the goods, the customer discovers that the wrong or defective goods have been sent to him or the goods do not reach the customer in good condition and in a sealed package, the e-shop must be notified immediately by sending a letter to info@myov.be
6. Return policy
6.1 After receiving the order, the purchaser has the right to withdraw from the contract entered into with the e-store within 14 days.
6.2 Purchased goods cannot be returned if they are manufactured or purchased for a client on a special order. The returned item must be in its original packaging and must not be used.
6.3 The right of withdrawal does not apply if the purchaser is a legal person.
6.4 To exercise the 14-day right of withdrawal, you must not use the ordered goods in any way other than is necessary to ensure the nature, characteristics and functioning of the goods in the same way you would be allowed to test the goods in an actual store.
6.5 If the goods have been used for any purpose other than is necessary to ensure the nature, characteristics and functioning of the goods, or if there are any signs of use or wear and tear, the online store has the right to lower the amount returned in accordance with the decrease in the value of the goods.
6.6 To return the goods, you must submit a declaration of withdrawal to the e-mail address info@myov.be within 14 days of
receiving the goods.
6.7 The purchaser shall bear the cost of returning the goods, except in cases where the reason for the return lies in the fact that a refundable product does not comply with the order (e.g. a wrong or defective product).
6.8 The purchaser must return the goods within 14 days of the submission of the declaration of withdrawal or submit evidence that they handed over the goods to the carrier within the aforementioned period.
6.9 Upon receiving the returned goods, the online store shall return to the purchaser, immediately but no later than after 14 days, all of the payments received from the purchaser based on the contract.
6.10 The online store has the right to refuse to make the refund until the goods being returned are received or until the buyer has provided proof of returning the products, whichever occurs first.
6.11 If the buyer has clearly chosen a different form of shipment than the cheapest usual form of shipment offered by the online store, the store is not required to compensate the cost exceeding the usual shipping cost.
6.12 The online store has the right to withdraw from the sale and demand that the goods be returned by the purchaser if the marked price of the goods in the online store is significantly lower than the market price of the goods due to an error.
7. Force majeure
7.1 The myov.be web store is not liable for the damage caused to the consumer or for delivery delays if the damage or delay is caused by circumstances that the myov.be web store could not foresee or control.
8. Processing of personal data
8.1 By entering their data at the web store and with a corresponding consent, the consumer agrees with the collection and processing of their personal data (name, phone number, delivery and/or home address, e-mail address) and the transfer of their personal data to the logistics partners for the delivery of goods.
8.2 The myov.be web store has the right to use consumer’s residence or other address for advertisements and other information to the consumer.
8.3 The consumer has the right to forbid the collection and use of their personal data at any time, except where this is necessary for the collection of a contractual claim or for the delivery of goods.
8.4 Electronic personal data are used for direct mail only if the consumer has given a separate consent for this on the myov.be website. The purchaser is able to opt out of offers and newsletters sent to their e-mail address at any time by letting us know via e-mail or by following the instructions in an e-mail containing an offer.
9. Complaints procedure
9.1 The web store is responsible for the non-compliance of goods sold to a purchaser with the terms and conditions of the contract or for deficiencies which already existed at the time of delivery and which occur within two years of delivering the goods to the purchaser. Within the first six months of delivery it is assumed that the defect was present at the time of delivery. It is the online store´s responsibility to prove otherwise.
9.2 If deficiencies occur, the consumer has the right to turn to the myov.be web store within two months by providing the invoice of the purchase.
9.3 We urge you to stop using the product when non-compliance or deficiencies occur.
9.4 The repair or replacement of defective goods shall be agreed between the web store and the consumer. The cost of repairing goods is borne by the myov.be web store.
9.5 The myov.be web store does not assume liability for defects that arose through the consumer’s fault, either due to improper storage or non-intended use.
9.6 Should the product exhibit non-compliance or deficiencies, e-mail your complaint to myov.be the exact description of the product’s non-compliance or deficiency.
9.7 Complaints about the non-compliance or deficiencies of the product have to be submitted within two months of detecting the non-compliance or deficiencies.
9.8 All complaints are reviewed and consumers are contacted as soon as possible, but no later than 14 days from the date of receiving the complaint.
9.9 The consumer has the right to request a reduction of the sales price or a termination of the contract and a refund for the goods from the myov.be web store, if the myov.be web store is not able to repair or replace the product, it fails to repair or replacement the product.
10. Settlement of disputes
All complaints made by a purchaser about the web store must be e-mailed to info@myov.be If the purchaser and the web store are not able to settle the dispute by agreement, the purchaser may contact the Consumer Dispute Committee. You can review the procedural rules and submit a complaint here. The Consumer Dispute Committee is competent to resolve disputes arising from a contract between a purchaser and the web store.
